New Law Taking Affect On February 10, 2009

 Maybe you heard of this and maybe you didn’t, but I would love to hear your opinions about this.

 This law was created due to the many problems with toys and clothing for kids made in China, and now it’s affecting all of us.

 It says that any item clothing or toys for children 12 and under used or handmade will be illegal to sell after February 10 of 2009 if you don’t have the certificate from government to sell it. Now this would be simple enough if the government wouldn’t charge a fortune to test those items.

“This law requires that any item that comes in contact with a child who is 12-years-old and under, to be tested at a government approved testing facility and have a ‘certification’ placed on the item.

The cost of having a single wood block tested is $150. To have a wooden baby’s teething rattle tested would be $4,000. Even books, DVDs, clothing, handmade toys or blankets, children’s clothing, the bags items are packed in and sold in, etc. come under this new law. Anything that comes into contact with a child under 12 years of age is required to be tested and certified.”

 So what does this mean for us stay at home moms and work at home moms who have made that extra income by making and selling handmade baby and children’s clothing and items???

 Many second hand stores will be closing now due to selling only stuff for children 12 and under, and many online handmade businesses will have to stop selling the items due to governments testing being so expensive. It is really awful and I’m sure prices of children’s clothing and toys won’t go down in the stores, but I guess we won’t have a choice but to buy there.

  • From what I understand there was some sort of ‘amendment’ done to the law earlier this month that had second-hand stores breathing a sigh of relief…I’ll have to find the link again… ;)

    The thing that really bugs me with this law is how ‘general’ and truly ‘vague’ it is. You would think that the responsibility to ‘test’ the materials should fall on the originating vendors…for instance, the material you use – thread, yarn, wood, paint, buttons, etc., etc… If you’re making something, you’re using materials that you purchased from someone who actually manufactured those materials, or had them manufactured. It shouldn’t be the responsibility of the person making the ‘end product’ to have the items tested, it should be on the people making the materials.

    My two-cents! ;)

  • i did see a article about this in the local paper that says it will make it very difficult for resalers as well.
    another stupid law to hurt the american people.

  • This subject has been on my mind for a few weeks now. I have been hand sewing, knitting and crocheting for children for about 10 years now. I believe that the government has opened a can of worms. I stumbled on this law on a whim. I agree with the previous comment above that the manufacturers of fabrics, thread, yarn, wood, paint, buttons, etc., should bear the brunt of having their product tested. Their products should reflect some kind of government seal on their packaging that their product is safe to use. Apparently those who wrote this law did not take into consideration the infinite number of crafters who make and sell their crafts…especially for children 12 years old and under.

  • I’m completely with you on this. In some ways I can understand the concern with reselling used clothing and toys, but I don’t agree with them on handmade clothing. It’s new and you are right the fabrics,yarn and accessories should be tested for approval.
    Because this law is not going to make stores mark down the prices, and it certainly will not stop this country to import toys and clothing from China and other similar countries.
    I think, no I know that our sewing rooms and knitting items are much cleaner than the places in those countries where majority of our clothes and toys are made. Wouldn’t you agree!

    I think this will be very hard to do, it will hurt so many people, so many small businesses.

  • I don’t know enough about it but think that it is terrible and not enough thought was put into it. I did hear they are making changes to it.

  • I understand the concern over lead in children’s products. I just had Shiloh’s lead levels tested, but I think they are going about this the wrong way. I don’t know what the solution is, but I don’t think this is it.

  • This new law was dreamed up by idiots! Anything children 12 and under could come in contact with, right? So what about furniture, carpet, curtains, kitchen items, linens? What about adult clothing, since we like to hug our kids? Do you have an older vehicle? Well after February 10th your children shouldn’t be allowed to ride in it, right? At least they shouldn’t unless you put them into a tall, plastic bag so they can’t touch it. If the government is so alfired concerned about chemicals being unhealthy for children, why do they spray our skies full of chemtrails? There are dozens of patents on chemtrails, some even containing bacteria. Morgellons disease is also in some of the varieties. Contaminate our air, our water, our food, but don’t you dare let your children play with old toys! LOL

  • how do you expect a person to make a dollar at a resale shop? This is a stupid law that had passed and i thought that the new president was out to help. Looks like he got our votes anyway.

  • Yah! Now that he got our vote he isn’t out to help the little businesses like he said he would. This is the wrong way to go with this law, i dont think it should of passed.

  • I am tring to make some money to feed my family and to get us the things we need and now i can’t because of this new law… What’s up with that???

  • I can’t own a car dealer or bank or a big company so i thought that i would open a resale shop. Looks like they’re only out to help the big bail outs
